If there is a default under a secured loan, the bank wants to know how to enforce its security. Difficulties may arise when security has been taken over assets that are, by their very nature, moveable.

For instance, aircraft are able to fly into different jurisdictions which may or may not be lender-friendly. Therefore, enforcement of the bank’s security over the aircraft will not only depend upon the law governing the mortgage over the aircraft, but also the law of the jurisdiction where the aircraft is situated and that in which the operator of the aircraft is incorporated.
