We are experienced advisers in disputes over
insurance or reinsurance contracts, acting for the insured as well
as for direct and reinsurance underwriters. We also advise brokers
and other intermediaries where issues arise as to their
conduct.
As insurance and reinsurance are international
industries, many of our cases involve overseas parties.
Together with our colleagues in funds and financial
regulation, we also advise on non-contentious matters, from
contract wordings and comparative dispute resolution techniques to
corporate reorganisations and schemes of arrangement.
We are members of ARIAS UK.
Our experience includes:
- acting in two major arbitrations concerning
the enforceability of reinsurance treaties centring on issues of
non disclosure/misrepresentation and the fraud of
intermediaries
- advising a reinsured on the interpretation of
the reinsurance treaty and the accumulation issues arising
- advising an insurer in relation to
allegations of mis-selling a financial product
