Our public and administrative law team advises clients from both
private and public sector on a wide range of administrative and
constitutional law issues regarding any kind of public-private
transactions or projects, i.e.:
- Complex PPP structures (DBFM/O, joint affiliates, concessions
of works or services, etc)
- Public procurement contracts
- Real estate transactions (sale, lease, long term lease,
building rights, etc)
- Financial transactions (loans, derivatives, securitization)
with or involving public authorities or entities
- Privatisation or reorganisation of public law companies.
Our public law lawyers team up with our banking, real estate,
corporate and tax lawyers, which guarantees an integrated approach
for all issues relating to such public-private projects and
transactions. As we work for both public and private sectors, we
have a perfect understanding of both public constraints and
financial and commercial terms. This allows us to come to well
balanced solutions, in particular in terms of risks allocation.
Our team also has a regulatory practice in pharma,
communications, energy and transport and works in close cooperation
with our other practices such as Competition & EU Regulatory,
Transport and Intellectual Property on those matters. This enables
us to provide a tailor made and complete “public, administrative
and regulatory advice”.
Its integration within the public & administrative London
group allows our Belgian public & administrative law team to
import creative solutions adopted in the UK into the Belgian
market. In particular, our Belgian public procurement team benefits
from the unique experience of the London team in terms of framework
agreement and competitive dialogue.
Our public and administrative team combines transactional
abilities with a strong contentious practice, before the State
Council as well as the judicial courts.
Key Responsibilities
The work is varied and likely to include:
- direct contact with clients under superivison of the
partner,
- managing of file (nature of work may be of contentious,
transactional or advisory nature) under supervision of the
partner;
- Drafting of memo’s, contracts, tender conditions, trial briefs,
etc
- attending hearings, and participating as required;
- Supervision of/delegation to junior colleagues where
appropriate.
Skills/Experience Required
- ± 5 years pqe in a related area;
- strong advocacy skills preferred;
- regulatory experience (healthcare, communication, energy,
waste) is desirable;
- previous regulatory experience is also desirable;
- French or Dutch at mother-tongue level and an excellent level
of Dutch/French and English;
- a good team player, but also comfortable working alone;
- ability to relate to clients/witnesses at all levels.
Other Information
- the successful candidate does not necessarily need to have a
personal following, however he/she must be able to demonstrate a
strong track record in building and developing client
relationships
- the successful candidate will be expected to fully participate
in marketing & practice development initiatives, including
speaking at seminars, article writing and entertaining;
