Field Fisher Waterhouse advises on creation of the Care Quality Commission and wins place on legal panel

Field Fisher Waterhouse LLP has advised on the establishment of
the Care Quality Commission, a newly created regulator responsible
for the regulation of services across the health and social care
sectors in England and Wales. The firm has also won a place on
the Commission’s legal panel.
From 1st April this year, the Care Quality Commission takes on
the functions of the three existing health and social care
regulators; the Commission for Social Care Inspection, the
Healthcare Commission and the Mental Health Act Commission. Its
role is to regulate health and social care and look after the
interests of people detained under the Mental Health Act.
Field Fisher Waterhouse advised the Care Quality Commission
transition team on the project which saw the merging of the
three existing regulators pursuant to a number of statutory
transfer schemes. The transfer schemes required commercial,
employment, regulatory, pensions and property law advice with
lawyers from across Field Fisher Waterhouse’s Corporate, Employment
& Pensions, Regulatory and Real
Estate Groups advising.
This is yet another high profile public sector project for the
firm and follows the provision of legal advice for the
establishment of the Commission for Equality and Human Rights which
also saw the merging of existing public sector bodies.
Field Fisher Waterhouse corporate partner Neil Palmer led on the project,
working with partners Mark Sellers (Real Estate), James Warren (Employment) and David Gallagher (Pensions).
Following the completion of the project, Field Fisher Waterhouse
has won a place on the Care Quality Commission’s legal panel,
advising on regulatory matters. The team advising will be led
by public & regulatory partner Sarah
Ellson. The firm has extensive experience advising
regulators in the healthcare sector with other clients including
the General Medical Council and the Human Fertilisation &
Embryology Authority.
