employment public sector  pensions

Caroline Casbolt joined Field Fisher Waterhouse LLP in 2002 and qualified in 2004. Caroline deals with both non-contentious and contentious employment and pensions matters for both private sector companies, public sector bodies and trade organisations.

Caroline advises on employee relation issues, such as poor performance and attendance, misconduct, illegal working, dismissals and exit packages through to Tribunal litigation, restrictive covenants and the employment aspects of business re-organisations and corporate transactions.

On the contentious employment side, Caroline's Tribunal workload covers unfair dismissal, trade union activities, breach of contract, TUPE, whistleblowing, equal pay and all aspects of discrimination law.  Caroline has particular expertise in complex multi-day discrimination and fraud claims involving voluminous documents.  She has acted on behalf of both Appellants and Respondents in the EAT. Caroline also has experience of settling disputes through judicial mediation.

Recently, Caroline has been advising two companies on the enforceability of post termination restrictions and potential injunctive proceedings in the High Court.  She has also advised public sector bodies in relation to discrimination claims pursued in the County Courts.

Caroline's non-contentious employment experience includes helping employers manage large scale redundancy issues and corporate support work, including due diligence exercises. She has drafted executive service agreements, contracts of employment, compromise agreements, company policies and handbooks.

Caroline has been developing a pensions specialism and has advised employers on areas that 'cross over' pensions and employment law, such as discrimination in Pension Schemes, consultation obligations, the abolition of default retirement, compulsory pensions and litigation.

Caroline presents seminars and workshops as part of the Employment and Pensions Group annual training programme and has written for the Employment Law Journal and Xpert HR.
