CHAMBERSMark Hodgson is a Partner in the IP and Technology Dispute Resolution Group at Field Fisher Waterhouse which he joined from Howrey's in 2011.

Mark specialises in advising pharmaceutical, medical device and biotechnology companies on intellectual property, regulatory, product liability and parallel importation matters. He has represented his clients successfully before the UK courts and has managed litigation on a multi-jurisdictional basis. His experience includes all forms of licensing including compulsory licensing as well as in advising clients on the intellectual property aspects of acquisitions.

He is recognised as a 'leading individual' in his field by both Chambers and Legal 500 as well as one of 'the top ten patent lawyers worldwide' by Global Counsel. He was one of The Lawyer magazine's 'Hot 100' lawyers in 2008. He led the team awarded 'TMT team of the year' in the Chambers Awards of 2009.

Mark has written numerous articles for legal and pharmaceutical journals and lectures extensively on matters such as parallel importation, enforcement, medicinal law regulations and strategic alliances.

Representative Matters

  • Lilly ICOS v Pfizer (2005). A high profile patent revocation action concerning the patent for the use of phosphodiesterase inhibitors (including VIAGRA) to treat impotence. Successful at first instance and on appeal.
  • Angiotech v Conor Medsystems (2007). Relating to the patent for the drug-eluting stent (TAXUS). The case concerns the appropriate test for determining lack of inventive step and Angiotech (Howrey's client) were successful before the House of Lords in June 2008. Leading IP case of the year.
  • Eli Lilly v Human Genome Sciences. Successfully represented Eli Lilly in July 2008 before the Patents Court in the leading UK authority on the law of industrial applicability. Also successfully defended the appeal before the Court of Appeal in 2009. The Supreme Court will hear the case (the first ever IP case heard by the  court) in July 2011.
  • Eli Lilly v Dr. Reddy. Successfully represented Eli Lilly in October 2008 against revocation action brought by generic companies aimed at invalidating Lilly's primary patent for olanzapine (ZYPREXA).
