James Lewis is a senior associate in the Dispute
Resolution department with a broad experience of commercial and
corporate disputes, often with an international angle. James
advises clients on breach of contract claims, shareholder disputes,
breaches of fiduciary duties and other commercial disputes
including civil fraud. His clients range from individuals to
multinationals and are drawn from a variety of industries.
The core of James's work is high court litigation although he
has a growing experience of domestic and international arbitration.
James has advised on several jurisdictional disputes and has
experience of applying for interim (including injunctive) relief in
the High Court. James advises clients on various forms of
alternative dispute resolution leading to successful negotiated
settlements in both High Court and arbitration proceedings.
Recent cases include the following:
- ICC Arbitration regarding the reconstruction of a football
stadium in Ukraine
- English arbitration and litigation regarding the construction
of a flagship hotel for a FTSE 100 company
- Arbitration regarding the activation of a refund guarantee
relating to the non-delivery by a Chinese shipyard of two 26,000
tonne bulk carriers
- Advising a UK parent company in relation to the validity of a
restructuring agreement with a Dubai bank concerning trade finance
loans in the light of alleged non-disclosure and fraud by the
bank
- Acting for an Australian food distributor in a dispute with its
English supplier regarding buy-back obligations at the termination
of a distribution agreement
- Acting for a major Italian cosmetics company in respect of
internal fraud including obtaining worldwide freezing order against
ex-chairman to secure assets
James contributes articles and case reports to various legal
publications. Recent items include an article on recent case
law relating to enforcement of judgments, and a
webcast on the House of Lords case of The Achilleas reviewing
the remoteness of damages rules in contract claims.
