Practices

EU regulatory

Almost all business are affected by regulations emanating directly from Brussels, or indirectly through national regulations conforming to an EU Directive. As a business, you may have prior warning of pending regulatory changes, through trade associations or technical fora. But, you need to be nimble enough to keep pace in this rapidly changing landscape, to recognise strategic threats and capitalise on potential opportunities.

The European Commission has positioned itself as the lead regulator in a number of fields, including chemicals, transport, pharmaceuticals, toys and climate change. As regulatory changes flow through, you need to respond, to adapt, comply or to challenge to protect your business and products.

How we can help

You need to be empowered to manage change whilst at the same time keeping your presence in your markets. In order to achieve this our team of EU regulatory specialists includes legal and technical experts who provide practical advice on current, pending and proposed regulatory issues.

If you use chemicals in your business – as a manufacturer, importer or retailer – you will be affected by the REACH or other sector specific regulations. As the leading agro-science regulatory practice, we can advise you on registrations, data compensation, arbitrations, appeals and participation and management of task forces, SIEFs and consortia, including the competition law dangers connected to the sharing of confidential information between competitors.  We can act as REACH Trustees, to handle data which protects you from such competition problems.

Our experience

We have extensive experience of advising businesses on a wide range of regulatory matters across Europe. This is formed on a deep understanding of the legislative and judicial processes at EU and national level; and knowledge of the sectors in which you operate. We have significant expertise in chemicals, pesticides, biocides, agro-science, environment/waste, gas, water, nuclear energy, telecoms, rail, aviation, pharmaceuticals, medical devices, cosmetics and food.

When it comes to dealing with regulators, we can both challenge and defend in your dealings with them. We have successfully challenged regulations across Europe. In the UK our Public and Regulatory Group represents many regulators, across many different industries.

We can:

  • successfully challenge government and EU decisions through judicial review in EU and national courts
advise you on the full range of regulatory issues, particularly in heavily regulated markets including
    pharmaceuticals, biocides and chemicals
  • understand the complex REACH or other specific regulations and their implications for your business
establish a REACH Trustee service to enable you to participate in consortia and share data without risking infringement of EU competition rules
  • lobby policy makers on your behalf
