Transparency in public procurements has always been of paramount importance.  But on 7 July 2008, the High Court in Lettings International Ltd v London Borough of Newham set the bar for transparency even higher.  In Newham, the Court unequivocally recognises the right of tenderers to be told all the features of the procurement that could affect the preparation of their tenders.  Post-Newham, the question for contracting authorities is not what must be disclosed but whether there is anything at all that can legitimately be withheld.
