Private sector involvement in the waste industry is continually
developing. The need to meet the EU requirements of the landfill
directive and avoid landfill taxes is a key issue in the push for
alternative methods of waste disposal and more private sector
involvement in waste.
Whilst there is a large pipeline of Private Finance Initiative
(PFI) waste projects, issues of new technology, planning,
environment and funding often hamper projects. Although the UK has
made great strides in involving the private sector, internationally
little progress has been made.

Our experience
Our lawyers have a wide range of experience in the waste sector
and includes:
- Advising a client and drafting an EPC contract for the design,
construction, operation and maintenance of an energy from waste
plant in the UK in excess of £100m.
- Advising 2K Manufacturing Ltd, one of the Guardian’s CleanTech
100 Companies in 2008, on a series A, Venture Capital funding
agreement with Foresight Group to support a multi-site rollout of
plastics recycling facilities.
- Advising a Joint Venture in relation to the construction of
£160 million 32 MW energy from waste plant at Colnbrook near
Slough.
- Advising a retailer on waste management and recycling issues,
including packaging waste and WEEE regulations and reviewing their
compliance systems.
- Advising a German client on the environmental aspects of the
purchase of two incinerators in the UK.
- Advising Tower Hamlets Community Recycling Consortium Limited
(THCRCL) on the outsourcing by the London Borough of Tower Hamlets
of community-based waste recycling services for 69,000 high-rise
dwellings.
